Man Accused of Computer Child Porn Gets Nine Months

A finding of diminished capacity has led a Southern District of New York judge to depart downward from federal sentencing guidelines for a man whose trading in child pornography was found to be peripheral to his obsession with sexual images online. Over the government's objection, the judge said he will issue a sentence of nine months in prison after psychological evaluations showed the defendant was not a sexual predator and had no interest in adult-child sex.
